Terms and user Agreement
part – 3 (continue of part-2)(JUMBODEAL GLOBAL SERVICES)
You further agree to
ensure that the listing description of the item must not be misleading and must
describe actual condition of the product. All listed items must be listed in an
appropriate category on the Website. All listed items must be kept in stock for
successful fulfillment of sales. If the item description does not match the
actual condition of the item, you agree to replace the product delivered to the
buyer with the correct product and/or refund any amounts that you may have
received from the buyer within 10 days of receipt of intimation from us in this
regard keeping in view return, refund & cancellation policy. You agree not
to list a single product in multiple quantities across various categories on
the site. Jumbodealglobal.com reserves the right to delete such multiple
listings of the same product listed by you in various categories.
Payments
jumbodealglobal.com uses
third party payment providers to receive payments from buyers on seller's
behalf. jumbodealglobal.com is not responsible for delays or erroneous
transaction execution or cancellation of orders due to payment issues. jumbodealglobal.com
takes utmost care to work with 3rd party payment providers, but does not
control their systems, processes, technology and work flows, hence cannot be
held responsible for any fault at the end of payment providers. Further, jumbodealglobal.com
may not release the payment to sellers until the order has been received by
Buyers and they are satisfied with it. Jumbodealglobal.com shall only make
payments to the sellers almost after a week has expired from the time payment
has been received from the buyer to us. The Seller payment is typically net of
the service fee charged by jumbodealglobal.com for its services, payment
charges if any and after deduction of applicable withholding taxes (if
any).
Jumbodealglobal.com
charges transaction fees to all sellers when their item is successfully sold on
the Site, listing fees for classifieds and special listing fees to sellers who
use the special listing feature for listing their items.
. We process online
payments on behalf of merchants and send the money to seller after deducting
our service fees. Merchants do not have to deal with online payments as we take
care of it. The sellers need to provide certain banking and accounting
information to set-up online bank transfer account. We have a weekly payment
cycle.
Taxes: You are responsible for paying all fees associated with the
use of the Website and you agree to bear any and all applicable taxes, charges,
ceases etc. levied thereon.
Non-payment: jumbodealglobal.com reserves the right to issue a
warning, temporarily /indefinitely suspend or terminate your membership of the
Website and refuse to provide you with access to all current and future use of
the Website in case of non-payment of fees by you to jumbodealglobal.com. jumbodealglobal.com also
reserves the right to take legal action in case of non- payment of fees.
Sellers must pay all fees
due and payable to jumbodealglobal.com after a successful sale and in the case
that a buyer does not complete the transaction; the seller may seek a refund of
the relevant transaction fees from jumbodealglobal.com by submitting an online
no-sale claim.
Before you list an item
for sale through the Site, we request you to review the fees that you will be
charged based on our Fees & Credit Policy which we may amend from time to
time with immediate effect by posting the changes on the Site.
jumbodealglobal.com may
choose to temporarily change the fees for our services for promotional events
(for example, free shipping days, special occasion sale) or new services, and
such temporary changes are effective in accordance with their terms when we
post them on the Site.
Unless otherwise stated,
all fees shall be quoted in your country's currency. You must pay all fees
payable to jumbodealglobal.com (and any applicable taxes or charges) within 30
days of the date of any invoice to you from jumbodealglobal.com with a valid
payment method as set out in our Fees & Credit Policy .
In case of non-payment of
fees and/or any applicable taxes and charges by you to jumbodealglobal.com,
without prejudice to any other rights and remedies of jumbodealglobal.com under
this User Agreement or at law, jumbodealglobal.com without liability reserves
the right to:
· issue you with a
warning regarding the non-payment in question.
· Temporarily or
indefinitely suspend, limit or withdraw your access to the Site and/or your
membership, if you fail to make the outstanding payment within 7 calendar days
of jumbodealglobal.com issuing a warning to you.
· Jumbodealglobal.com
also reserves the right to take any necessary steps including legal action in
case of non-payment of fees by you to jumbodealglobal.com
.
· invoice you for a
fixed late payment fee (as set out in our Fees and Credit Policy from time to
time). or
· take any steps jumbodealglobal.com
considers necessary including without limitation legal action for recovery of
the outstanding fees and/or any applicable taxes and charges.
No Warranty
Jumbodealglobal.com and
its suppliers, affiliates and service providers provide the Website and
services "as is" and without any Warranty or condition, express,
implied or statutory and specifically disclaim any implied Warranties of title,
merchantability, fitness for a particular purpose and non-infringement. You
expressly agree that your use of the Website is at your own risk.
Disputes
A
'Dispute' can be defined as a disagreement between a Buyer and a Seller in
connection with a transaction on the Website. Disputes arise out of an issue
that is raised by either party not being completely satisfied with the
resolution of their complaint/issue.
It is important that before a Buyer/Seller raises a dispute, they should
attempt to resolve the issue amicably between each other. Please note that
whenever a buyer raises a dispute, the seller's payment for that order is put
on hold immediately until the issue is resolved
Generally, transactions are conducted smoothly on jumbodealglobal.com. However
there may be some cases where both the Buyers and Sellers may face issues. At jumbodealglobal.com,
we have a Dispute Resolution process in order to resolve disputes between
Buyers and Sellers.
How is a 'dispute' resolved?
Whenever there is a disagreement relating to any transaction, the users can
write to care@jumbodealglobal.com in order to
raise a dispute. Once a dispute is raised by either party, jumbodealglobal.com
shall try to mediate and the resolve the matter amicably.

Arbitration
If any
dispute arises between you and jumbodealglobal.com during your use of the
Website or thereafter, in connection with the validity, interpretation,
implementation or alleged breach of any provision of the User Agreement, or the
documents they incorporate by reference, the dispute shall be referred to a
sole Arbitrator who shall be an independent and neutral third party identified
by jumbodealglobal.com. The place of
arbitration shall be Ahmadabad, India. The arbitration proceedings shall be in
the English Language and shall be governed by Arbitration & Conciliation
Act, 1996.
Governing
Law
The User
Agreement or the documents they incorporates by reference shall be governed and
construed in accordance with the laws of India. Subject to above clause, all
disputes arising under this Agreement between you and jumbodealglobal.com
shall be subject to the exclusive jurisdiction of courts.
